This is one of the firm’s emerging areas of practice. As can be appreciated, the newly enacted Energy Act and regulations therein have in many ways changed the market structure of the energy industry and legal disputes are becoming more important and frequent. We are currently advising and acting as lead counsel to the Kenya Petroleum Refineries Limited in a legal dispute with two (2) oil importers in a case that is likely to create a favourable and important legal precedent on the operations of the refinery as well as the Open Tendering System. We have also in the recent past (2008) been part of a legal advisory panel engaged by the Ministry of Energy to consider and advise on proposed amendments to the legal framework of energy laws for the better regulation of the energy industry.
